Market access, not just penalties

Under Article 28 an EU controller may only use a processor that provides sufficient guarantees — documented in a data processing agreement. That obligation sits on your buyer. If you cannot sign a workable DPA, name your sub-processors and explain your transfer mechanism, their legal team blocks the purchase. The fine risk is theirs before it is yours.

  • Breach notification within 72 hours, contractually flowed down to you.
